At Success Engine, we believe there shouldn't be any surprises. These Terms of Use explain what you're purchasing, what we provide, what we need from you, how your website is created and maintained, who owns your domain and business materials, how hosting works, and what happens if you decide to leave.

By electronically accepting these Terms and purchasing Success Engine services, you acknowledge that you have read, understood and agree to these Terms of Use.

1. The Success Engine Website Service

Success Engine provides professionally designed websites primarily for local and small businesses that want a credible online presence without the cost, complexity or lengthy process associated with traditional website projects.

Our standard website service consists of:

The standard website is a professionally designed, mobile-friendly one-page website with organized sections that visitors can navigate using links or buttons. The content, design and functionality of each website will vary based on the Client's business, information, photographs, branding, services and other materials provided during onboarding.

2. What Is Included in the $500 Website

The standard $500 website may include, as appropriate for the Client's business:

The standard package does not include unlimited pages, extensive custom programming, e-commerce, advanced booking systems, customer portals, advanced SEO campaigns, paid advertising, extensive ongoing content creation or other services outside the standard website scope unless separately purchased.

3. The One-Page Website

The standard Success Engine website is a one-page website. Business information is organized into clearly defined sections that visitors can access through navigation links or buttons — for example: Home | About | Services | Testimonials | Contact

A one-page structure allows us to provide a professional, easy-to-navigate website while keeping the project simple and affordable. A Client who later needs additional pages, features or functionality may request an upgrade or separate project quote.

4. The Onboarding Process

The Client begins by completing the Success Engine onboarding process, designed to gather the information needed to create the website. Starting the onboarding process does not create a payment obligation. The Client may complete the process, review the information provided and decide whether to proceed before making the $500 payment. The website development agreement becomes effective when the Client accepts these Terms and completes the required $500 payment.

5. Payment & Website Production Process

Step 1 — Complete Onboarding

The Client provides the business information and materials needed to create the website.

Step 2 — Pay the $500 Website Development Fee

Once payment is received, Success Engine begins website production.

Step 3 — Website Build Fee Payment

Once the Client has completed onboarding and is ready to proceed, the one-time $500 website build fee is due before design and development begins. No design or build work commences prior to receipt of this payment.

Step 4 — Website Development

Success Engine designs and builds the Client's custom one-page website based on the information and materials provided by the Client.

Step 5 — Client Review & Approval

The Client reviews the website and requests reasonable revisions within the agreed scope.

Step 6 — First Hosting Payment

Once the Client approves the website for launch, the first $30 hosting payment is due.

Step 7 — Website Launch

The website is launched after the applicable hosting payment has been received and the technical requirements for launch have been completed.

6. Client Content & AI-Assisted Content Development

The Client provides the business-specific facts, information, photographs, testimonials, logos and other materials needed for the website. Success Engine may organize, edit, rewrite, improve, summarize or otherwise refine information provided by the Client in order to develop polished website content. Success Engine may use artificial intelligence and other software-assisted tools as part of this process.

The Client remains responsible for reviewing the completed website and confirming that factual information relating to its business is accurate before approving the website — paying particular attention to names, addresses, phone numbers, pricing, licenses, certifications, service descriptions, testimonials and other business-specific information.

7. Client Materials

The Client represents that it has the right to provide Success Engine with any photographs, logos, testimonials, written content, trademarks, graphics or other materials supplied for use on the website. The Client authorizes Success Engine to use those materials for the purpose of creating and operating the Client's website. Success Engine may decline to use materials that appear to infringe another person's rights or that are unlawful, misleading, inappropriate or technically unsuitable.

8. Website Design

Success Engine uses proven design techniques, layouts, components, technology and production systems to create websites efficiently and keep the standard service affordable. Each Client website is customized using the Client's business name, services, information, photographs, testimonials, branding and other applicable materials. However, Success Engine may use reusable design systems, templates, frameworks, components, code libraries, software, production methods and other resources across multiple websites. A customized website does not mean that every element is uniquely programmed or created from scratch.

9. Website Review & Revisions

The Client will have an opportunity to review the website before launch. Success Engine will make reasonable revisions necessary to correct errors, clarify information, adjust content and bring the website into substantial alignment with the agreed project scope. The standard $500 website package includes up to three (3) rounds of revisions before launch. A revision round consists of the Client reviewing the live preview and submitting a consolidated list of requested changes. Reasonable revisions include corrections to copy, layout adjustments and changes to colors or photos. After each revision round, Success Engine will implement the requested changes and provide an updated preview for Client review. Reasonable revisions do not include changes to the fundamental design concept, requests to rebuild the site in a different style, addition of new pages, new sections significantly beyond the original scope, or repeated wholesale redesigns. Requests that fall outside reasonable revisions, or revision requests beyond the three included rounds, are billed at a flat fee of $100 per additional revision round. This rate does not increase with the number of rounds requested. Success Engine will notify the Client of the applicable fee before beginning the work and will charge the payment method the Client provided at checkout. A Client who prefers not to proceed may decline, in which case the website remains as last approved. Requests to add new pages, new functionality or work materially beyond the original project scope are not revision rounds and will be quoted separately.

10. Website Timeline

Our normal goal is to have the initial website ready for Client review within approximately 3–5 business days after we receive the information and materials reasonably necessary to build the site. This is an estimated production timeframe and is not a guaranteed deadline. The timeline may be extended by delays in receiving Client information, additional revision requests, changes in scope or circumstances outside Success Engine's reasonable control.

11. Satisfaction Guarantee

Our $500 Satisfaction Guarantee means that if we cannot get you comfortable with the finished website after reasonable discussion and revisions within the agreed scope, we will refund your $500 website development fee.

Our promise is simple: If we can't get you comfortable with the finished website, we'll refund your $500.

The website is not transferred or delivered when a refund is issued. A refund represents cancellation of the website project. If a full $500 refund is issued, the Client does not receive website files, source files, a transfer package or a right to independently host or reproduce the website, and any hosting relationship is terminated.

Website File Transfer. The Client owns their website content and design. If the Client wishes to receive the website source files for independent hosting elsewhere, Success Engine will provide a packaged file transfer upon request for a one-time transfer and packaging fee. This fee covers the preparation, documentation and delivery of all website files. The domain name is always the Client's property and is not subject to any transfer fee.

The satisfaction guarantee applies only to the $500 website development fee. It does not apply to hosting charges, domain registration or renewal fees, third-party services or separately purchased services.

12. Domain Names & DNS Connection

Domain Ownership. Your domain always belongs to you. The Client is responsible for purchasing, registering, renewing and maintaining its own domain name. Success Engine does not purchase or register domains and does not take ownership of a Client's domain at any time.

Website Ownership. The Client owns their website content and design. The website is hosted on Success Engine infrastructure as part of the monthly hosting service. If the Client wishes to receive the website source files for independent hosting elsewhere, Success Engine will provide a packaged file transfer upon request for a one-time transfer and packaging fee. Domain ownership and website ownership are separate — your domain is always yours regardless of your hosting status.

If you already own a domain, Success Engine will provide the information needed to connect it to the new website. Normal domain connection assistance is included in the standard website service. If you do not already have a domain, you will need to purchase one before your website can be launched. Domain registration and renewal fees are separate from the $500 website development fee and $30/month hosting service. The Client is solely responsible for keeping its domain registration active and renewing it before expiration.

13. Website Platform, Use & Ownership

The Client retains ownership of its business name, business information, original photographs, client-owned logos, testimonials, original written materials and domain name. Success Engine retains ownership of its underlying website platform, reusable templates, design systems, frameworks, code, production methods and other underlying technology. The Client receives the right to use its completed website for its business while maintaining an active Success Engine hosting relationship and complying with these Terms.

14. Secure Hosting, HTTPS & SSL

Every hosted website receives HTTPS with an automatically provisioned and renewed SSL/TLS certificate. The hosting environment uses modern security measures including DDoS protection, traffic monitoring, isolated build environments, secure website architecture, globally distributed content delivery and controlled website deployments.

While Success Engine uses professionally managed hosting infrastructure and reasonable security practices, no website or Internet-connected system can be guaranteed to be completely immune from hacking, malware, outages, data loss or other security events.

15. Backup & Recovery

Where applicable, automated backup and recovery capabilities may be available. Standard one-page websites may consist primarily of website files and assets and may not require database backups. Clients should retain copies of important original business materials, including photographs, logos, documents and other files supplied to Success Engine.

16. $30/Month Hosting & Maintenance

The monthly $30 service includes: Secure Website Hosting · HTTPS/SSL · Security Infrastructure · Website Maintenance (one reasonable round of minor website edits per month) · Technical Website Support. You run your business. We take care of the website.

17. Monthly Website Edits

One reasonable round of minor website edits is included each month — correcting text, updating a phone number, changing business hours, updating a service description, replacing a photograph or making similar small content changes. The monthly maintenance service is intended to keep the existing website current, not to provide a redesign every month. Larger changes, including website redesigns, major layout changes, additional sections, additional pages, new functionality, advanced SEO or custom programming, may be quoted separately.

18. Hosting Billing & Initial 12-Month Commitment

The standard hosting price is $30 per month. The first $30 hosting payment is due after the Client approves the website and before the website is launched. The initial hosting commitment is 12 months, beginning when hosting is activated and the website is launched.

We are intentionally transparent about this commitment. Our business model allows us to provide a professionally built website for $500 by combining the affordable upfront website price with an ongoing hosting and maintenance relationship. The initial 12-month commitment helps us recover the cost of designing, preparing, launching and supporting the website while keeping the upfront price affordable.

19. Recurring Billing

The Client authorizes Success Engine, or its designated payment processor, to charge the Client's selected payment method for applicable monthly hosting charges. Before enrollment, the Client will be shown the $30 monthly price, billing frequency, initial 12-month commitment, and the applicable cancellation procedure. The Client is responsible for maintaining valid payment information.

22. Payment Failure & Grace Period

If a scheduled hosting payment fails, Success Engine's payment processor will automatically retry the charge up to three times over a seven-day period. The Client will receive an automated notification on each failed attempt.

If payment is not successfully collected within seven days of the original due date, Success Engine will send a courtesy notice to the Client's account email address. The following timeline then applies:

Reactivation of a suspended account requires payment of all overdue amounts before the website is restored. Success Engine reserves the right to modify this grace period schedule with reasonable notice.

20a. Annual Renewal Notice

Approximately 30 days before the end of the initial 12-month hosting commitment, Success Engine will send the Client a notice confirming that hosting will automatically continue on a month-to-month basis at $30/month unless the Client provides cancellation notice. No action is required if the Client wishes to continue.

23. Hosting After the First Year

After the initial 12-month hosting commitment, hosting continues at $30 per month, month-to-month, with no additional long-term commitment. The Client may cancel according to the cancellation provisions below.

23. Cancellation

During the Initial 12-Month Term: The Client may request cancellation, however the unpaid balance of the remaining committed monthly hosting charges becomes due upon early termination, unless otherwise required by applicable law or agreed in writing.

After the Initial 12-Month Term: Hosting is month-to-month and may be cancelled at any time. Previously paid hosting fees are not refundable for unused portions of a billing period unless otherwise required by law.

24. What Happens If You Leave Success Engine?

We hope you'll remain a Success Engine customer because our goal is to provide a website service that is useful, convenient and worth keeping. However, we do not want customers to feel trapped. After the initial 12-month hosting commitment has been satisfied, the Client may cancel its hosting relationship with Success Engine.

Because the website is created and maintained as part of our managed website platform, cancellation of hosting does not automatically include a complete, ready-to-host copy of the website. Clients who want assistance transitioning away from Success Engine may purchase our $150 Website Transition Service.

25. $150 Website Transition Service

The $150 Website Transition Service covers the reasonable administrative and technical time involved in preparing for a Client's transition to another hosting provider. The standard transition service may include: organizing Client-provided content and assets, preparing available transferable website files, providing domain and DNS information or instructions, providing applicable website configuration information, reasonable communication with the Client or new hosting provider, one transition call of up to 30 minutes, and one reasonable follow-up communication.

The $150 fee is a service fee for transition assistance — not a cancellation fee. It does not include setting up the Client's new hosting account, rebuilding the website on another platform, or extensive migration work. Additional work beyond the standard transition service will be explained and quoted before proceeding.

26a. Offboarding Procedure

When a Client requests cancellation after the initial 12-month commitment, the following standard procedure applies:

  1. Client submits cancellation request in writing to [email protected].
  2. Success Engine confirms receipt and identifies the final billing period.
  3. If the Client has purchased the Website Transition Service, Success Engine prepares the packaged website files.
  4. Client receives DNS handoff instructions explaining how to point their domain away from Success Engine hosting.
  5. Upon confirmed receipt of files (if applicable), the Client’s website is removed from Success Engine hosting.
  6. The Client’s domain registration is unaffected — the domain remains at the Client’s registrar.
  7. Success Engine retains an archive of website files for a minimum of 12 months following termination.
  8. A cancellation confirmation email is sent to the Client.

Success Engine will not cancel, transfer or modify a Client’s domain registration as part of this process.

26. Why Is There a $150 Transition Fee?

Moving a website to another provider is not simply a matter of sending a customer a folder. The process may require gathering and organizing assets, preparing available files, documenting applicable settings, providing domain or DNS information, and communicating with another provider. The $150 fee helps cover the time involved while giving the Client a predictable cost for standard transition assistance. You are free to leave after your initial commitment. If you want our assistance making the transition, we charge a clearly defined fee for that work.

26b. Client Support & Communication

After launch, the Client may contact Success Engine for hosting support and questions at [email protected]. Success Engine will make reasonable efforts to respond to support requests within two (2) business days during normal business hours (Monday–Friday).

Content updates, design changes, additional pages or other work beyond the original scope requested after launch are not included in the monthly hosting fee and will be quoted separately before any work begins.

Success Engine’s preferred method of communication is email, as this creates a clear written record of all requests, approvals and outcomes, protecting both the Client and Success Engine.

27. Contact Forms & Customer Inquiries

Where included, contact or quote forms are configured using the contact information supplied by the Client. The Client is responsible for providing the correct destination email address, monitoring incoming inquiries, responding to potential customers, and keeping contact information current. Success Engine does not guarantee a particular number of form submissions, leads, calls, sales or customers.

28. Business Email

Business email is not included in the standard $30/month website hosting service. If the Client wants a professional email address using its domain (such as [email protected]), Success Engine may offer email setup or related services as an additional service.

29. Search Engine Optimization & Google

The standard website includes basic search-engine-friendly structure and content. Success Engine does not guarantee a specific Google ranking, first-page ranking, specific amount of search traffic, leads or customers. Search visibility depends upon many factors outside Success Engine's control. Additional or more advanced SEO services may be purchased separately.

30. Business Results

A professional website can help a business present itself professionally, establish credibility, showcase its services, explain what it offers, and make it easier for potential customers to call or make contact. However, Success Engine does not guarantee a specific number of visitors, leads, calls, appointments, customers, sales, revenue, search rankings or return on investment.

31. Additional Services & Upgrades

The $500 website is intended to be an affordable starting point. As a Client's needs grow, Success Engine may offer additional services such as logo design, branding, advanced SEO, additional website pages, additional functionality, content development, professional business email setup, print materials, signs, apparel, trade-show materials and other business-support services. Analytics setup, reporting, monitoring and related services are not included in the standard $500 website package and may be purchased separately. Additional services are not required and are quoted separately. You don't have to buy everything at once.

32. Third-Party Services & Technology

A website may depend upon third-party services or technology, including domain registrars, email providers, payment processors, analytics services, maps, forms, fonts, software, plugins, APIs or other technology providers. Third-party services may have their own fees, terms, limitations, outages, changes or restrictions. Success Engine is not responsible for third-party failures outside our reasonable control.

33. Legal, Privacy & Regulatory Requirements

Unless separately purchased or expressly included in writing, Success Engine does not provide legal advice and does not guarantee that a website satisfies every legal, privacy, accessibility, regulatory or industry-specific requirement applicable to the Client's business. The Client is responsible for determining which requirements apply to its business.

34. Accessibility

Success Engine seeks to create websites that are readable, usable, mobile-friendly and accessible to a broad audience. However, the standard $500 website package does not constitute a legal guarantee of compliance with ADA, WCAG or another accessibility standard unless a separate accessibility service has been specifically agreed to in writing.

35. Client Responsibilities

The Client agrees to provide accurate business information, provide materials it has the right to use, review the website before launch, respond reasonably promptly to questions and revision requests, maintain ownership and registration of its domain, maintain valid billing information, pay agreed fees when due, and comply with applicable laws governing the Client's business and website.

36. Prohibited or Unlawful Content

Success Engine will not knowingly create or host content that is unlawful, fraudulent, defamatory, threatening, abusive, intentionally misleading or otherwise prohibited by applicable law. Success Engine may refuse to use or host materials that create a reasonable legal, security, technical or reputational risk.

37. Suspension of Services

Success Engine may temporarily suspend hosting or other services when reasonably necessary because of nonpayment, security concerns, malware, illegal activity, abuse of the hosting environment, violation of these Terms or third-party platform requirements. Whenever reasonably practical, Success Engine will provide notice and an opportunity to correct the issue.

38. Website Availability

Success Engine will make reasonable efforts to keep hosted websites available. However, uninterrupted availability cannot be guaranteed. Temporary downtime may result from maintenance, infrastructure issues, security events, software changes, third-party outages or circumstances beyond Success Engine's reasonable control.

38. Client Content vs. Success Engine System

Client-Provided Content includes all materials supplied by the Client: business name, service descriptions, contact information, hours of operation, photographs, logos, testimonials, and any other content the Client provides during onboarding or thereafter. This content belongs to the Client.

Success Engine System includes the design templates, code structure, layout systems, CSS frameworks, component patterns, and technical infrastructure developed and maintained by Success Engine. This system is the property of Success Engine and is licensed to the Client as part of the hosted website service.

The Website Transition Service (Section 25) delivers Client-provided content and available website files. It does not include a transfer of Success Engine's underlying design system, templates, or proprietary code components.

39. Portfolio & Marketing Use

Unless the Client requests otherwise in writing, Success Engine may display screenshots, links or descriptions of completed websites in its portfolio, website, social media and marketing materials. A Client may request in writing that its website not be displayed publicly as part of Success Engine's portfolio.

40. Limitation of Liability

To the fullest extent permitted by applicable law, Success Engine will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue or loss of data arising from the services. Success Engine's total liability arising from the services will not exceed the amount paid by the Client to Success Engine during the twelve months immediately preceding the event giving rise to the claim.

41. Client Indemnification

The Client agrees to defend, indemnify and hold harmless Success Engine, its owners, employees, contractors and service providers from claims, damages, liabilities, costs or expenses arising from Client-provided content, photographs or materials, false or misleading information supplied by the Client, the Client's business practices, the Client's violation of applicable laws, or the Client's misuse of the website.

42. Termination by Success Engine

Success Engine may terminate or suspend services for material violation of these Terms, nonpayment, unlawful activity, security concerns or circumstances where continued service is reasonably impractical or unsafe. Outstanding amounts owed by the Client remain payable.

43. Changes to Third-Party Technology

Third-party products used in a website may be discontinued, changed, repriced, restricted or replaced. Success Engine will make reasonable efforts to identify a practical alternative when appropriate. Additional work required because of such changes may be quoted separately.

44. Independent Service Provider

Success Engine is an independent service provider. Nothing in these Terms creates a partnership, joint venture, employment relationship, franchise relationship or agency relationship between Success Engine and the Client.

45. Electronic Acceptance

The Client agrees that checking an acceptance box, clicking an acceptance button or otherwise electronically indicating acceptance constitutes the Client's electronic signature and agreement to these Terms, to the extent permitted by applicable law.

46. Changes to These Terms

Success Engine may update these Terms from time to time. Changes generally apply to new purchases and new service agreements after the effective date of the revised Terms. If a material change affects an existing Client's recurring hosting relationship, Success Engine will provide notice where required by applicable law.

47. Governing Law

These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms will be handled in a court of competent jurisdiction located in Bay County, FL.

48. Entire Agreement

These Terms, together with the Client's order, onboarding information, payment agreement and applicable service description, constitute the agreement between Success Engine and the Client regarding the services purchased.

49. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

50. Waiver

Failure by Success Engine to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision in the future.

51. Force Majeure

Success Engine will not be responsible for failure or delay caused by events beyond its reasonable control, including natural disasters, power outages, Internet or telecommunications failures, cyberattacks, government action, labor disruptions, third-party service failures or other events that could not reasonably have been prevented.
